Terms & Conditions
The following terms and conditions apply to all website development / design services provided by My Website Made Simple Limited to the Client.
It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any purchase or use of our services implies that you have read and accepted our terms and conditions.
2. Turnaround Time and Content Control
My Website Made Simple LLC will install and publicly post or supply the Client's website within 14 days of the project start date, or at date agreed with the Client upon My Website Made Simple LLC receiving initial payment, unless a delay is specifically requested by the Client and agreed by My Website Made Simple LLC.
In return, the Client agrees to delegate a single individual as a primary contact to aid My Website Made Simple LLC with progressing the commission in a satisfactory and expedient manner. During the project, My Website Made Simple will require the Client to provide website content; text, images, movies and sound files.
Charges for services to be provided by My Website Made Simple LLC are defined in the package offered to clients. Each package is valid for a period of 30 days, 6 months, 12 months, and 24 months. My Website Made Simple LLC reserves the right to alter or decline to provide a quotation after expiry of the 30 days. Unless agreed otherwise with the Client, all website design services require full payment when the website is published. The client will have 3 correction periods within 14 days of being published. Payment for services is by credit card.
Hosting with out a Subscription
*Any updates you will be charged $65 per hour without a current subscription plan.
*First year annual hosting fees waived. After, the first year a $299.00 per year hosting and maintenance fee is required on the January 1.
*Service Calls would include updating or changing pictures and text to website. We have support available daily to answer any questions or concerns.
4. Client Review
My Website Made Simple LLC will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies My Website Made Simple LLC otherwise within (7) days of the date the materials are made available to the Client.
5. Project delays and client liability
Any time frames or estimates that we give are contingent upon your full co-operation and complete and final content in photography for the work pages. During development there is a certain amount of feedback required in order to progress to subsequent phases. It is required that a single point of contact be appointed from your side and be made available on a daily basis in order to expedite the feedback process.
6. Approval of work
On completion of the work you will be notified and have the opportunity to review it. You must notify us of any unsatisfactory points within 7 days of such notification. Any of the work which has not been reported in writing to us as unsatisfactory within the 7-day review period will be deemed to have been approved. Once approved, or deemed approved, work cannot subsequently be rejected and the contract will be deemed to have been completed and the full price will become due.
My Website Made Simple LLC hereby excludes itself, its Employees and or Agents from all and any liability from:
Loss or damage caused by any inaccuracy;
Loss or damage caused by omission;
Loss or damage caused by delay or error, whether the result of negligence or other cause in the production of the web site;
Loss or damage to clients' artwork/photos, supplied for the site. Immaterial whether the loss or damage results from negligence or otherwise.
The entire liability of My Website Made Simple LLC to the Client in respect of any claim whatsoever or breach of this Agreement, whether or not arising out of negligence, shall be limited to the charges paid for the Services under this Agreement in respect of which the breach has arisen.
8. Website Maintenance
There are no required maintenance fees other than domain registration and hosting.
9. Search Engines
We do not guarantee any specific position in search engine results for your website. We perform basic search engine optimization according to current best practice.
You may agree to a one (1) month, six (6) month, twelve (12) month or twenty-four (24) month contract agreement with My Website Made Simple. Some of the features on the Service require payment of fees, as described for each Service on the Site (“Fees”). If you sign up for these features, you must pay all applicable feature Fees. We reserve the right to change our prices and/or bundle certain parts of the Service together for pricing purposes, and may do so at any time. You authorize us to make any reasonably necessary inquiries to validate your account and financial information.
All Fees are in USD and are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment thereof. If you purchase any Services that we offer for a Fee, you consent to My Website Made Simple, or our third party service providers, storing your payment card information and you authorize us to charge you (a) any Fees for Services you may purchase, and (b) any applicable taxes in connection with your use of the Services to the payment card you provide, and you will reimburse us for all collection costs and interest for any overdue amounts. If the payment card you provide expires and you do not provide new payment card information or cancel your account, you authorize us to continue billing you and you will remain responsible for any uncollected Fees.
11. Cancellation; Service Changes
In the event of cancellation or non-renewal of your website, the client agrees to mail or email prior written notice of cancellation at least 30 days in advance to My Website Made Simple 1968 S Coast Hwy #505, Laguna Beach, CA 92651 or by email Info@Mywebsitemadesimple.com
If you cancel the Service, your cancellation will take effect immediately following your last payment. After cancellation, you will no longer have access to your web site and we may delete all information on your web site. We accept no liability for such deleted information or content.
12. Money Back Guarantee Limited
14-day Money Back Guarantee on Hosting: If you are not completely satisfied with our services within the first 14 days from the opening of the account, you will be given a refund. If you cancel after the first 14 days, you will be obligated to pay all fees and charges accrued prior to the effective date of the cancellation. Refunds will be issued back to you within 10 business days from your cancellation date.
